Terms of Service
These Terms of Service govern your access to and use of Momentory. By creating an account, creating an event, purchasing a paid package, or using the service, you agree to these Terms.
1. Service Description
Momentory is a self-serve digital software platform for creating QR-based event galleries and collecting guest-generated photo and video uploads. Momentory is operated by WIT SOCIAL LLC, a limited liability company based in the United States.
Momentory allows event hosts to create an event page, prepare a QR code, invite guests to upload media, manage uploaded content, and access collected event media through the platform.
Momentory is provided as a digital software service. We do not provide physical goods, in-person event services, photography services, printing services, or marketplace access.
2. Accounts and Event Setup
You may need to create an account to use certain features of Momentory.
Creating an account, creating an event, preparing an event page, or generating a QR code may be available before payment. These setup actions do not necessarily mean that the paid digital service has started.
You are responsible for keeping your account information accurate and for maintaining the security of your account.
3. Paid Service
Pricing may be event-based, package-based, or otherwise displayed at checkout.
The paid digital service generally begins when a paid event gallery starts receiving guest photo or video uploads, or when you otherwise begin using paid features made available after purchase.
The features included in each package are described on the pricing page or checkout page at the time of purchase.
4. Payments
Payments for Momentory may be processed by our payment provider. Depending on the payment method and checkout used, our payment provider may handle payment processing, invoices, taxes, refunds, and related transaction support.
You agree to provide accurate billing and payment information. Prices, taxes, fees, and payment terms may be displayed at checkout before purchase.
5. Refunds and Withdrawal
Refunds, cancellations, and statutory withdrawal requests are handled according to our Refund / Withdrawal Policy.
Because Momentory provides digital services that may begin after purchase, refund rights may depend on your location, applicable consumer law, the activation status of the paid service, and the extent of use.
If you have purchased a paid package but have not yet received any guest photo or video uploads through the paid event gallery, you may request a refund within 14 days of purchase, subject to applicable law and our Refund / Withdrawal Policy.
Once the paid event gallery starts receiving guest uploads, the paid digital service is considered to have started, and refund rights may be limited.
6. User Content
You are responsible for all content uploaded, submitted, stored, shared, or displayed through Momentory, including content uploaded by guests to your event gallery.
You represent that you have the necessary rights, permissions, and consent to upload, collect, store, display, and use such content through Momentory.
You retain ownership of your content. By using Momentory, you grant us a limited permission to host, store, process, display, and deliver your content only as necessary to operate and provide the service.
7. Guest Uploads
If you invite guests to upload photos or videos to your event gallery, you are responsible for making sure that your use of Momentory and your collection of guest media complies with applicable laws and privacy expectations.
You should not use Momentory to collect sensitive, illegal, harmful, or unauthorized content.
8. Prohibited Use
You agree not to use Momentory to:
- upload, collect, store, or share illegal, harmful, abusive, hateful, exploitative, or infringing content;
- violate the privacy, intellectual property, publicity, or other rights of any person;
- upload malware, spam, or content designed to disrupt the service;
- attempt unauthorized access to accounts, systems, or data;
- interfere with the security, availability, or operation of the service;
- use the service for fraudulent, deceptive, or unlawful purposes.
We may remove content, restrict access, suspend accounts, or terminate service if we believe these Terms have been violated or if required by law.
9. Content Moderation and Removal
We may review, restrict, or remove content if we believe it violates these Terms, applicable law, third-party rights, or platform safety requirements.
We are not responsible for monitoring all user or guest content in advance, but we may take action when issues are reported or detected.
10. Service Availability
We aim to provide a reliable service, but we do not guarantee that Momentory will always be available, uninterrupted, error-free, or compatible with every device, browser, or network.
Temporary interruptions may occur due to maintenance, updates, technical issues, third-party providers, or circumstances outside our control.
11. Service Changes
We may update, modify, suspend, or discontinue features, pricing, packages, or functionality from time to time.
Material changes may be communicated when appropriate. Changes will not affect any mandatory rights you may have under applicable law.
12. Third-Party Services
Momentory may rely on third-party providers for hosting, storage, payments, email delivery, analytics, or other infrastructure.
We are not responsible for third-party services except where required by applicable law.
13. Intellectual Property
Momentory, including its software, design, branding, website, and related materials, is owned by us or our licensors.
You may not copy, modify, reverse engineer, resell, or misuse any part of the service except as permitted by these Terms or applicable law.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Momentory is provided on an “as is” and “as available” basis.
We are not liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, loss of data, loss of business, or loss arising from unauthorized use of your account or content, except where liability cannot be limited under applicable law.
15. Termination
You may stop using Momentory at any time.
We may suspend or terminate your access to the service if you violate these Terms, misuse the service, create legal risk, or if continued access would harm the service, other users, or third parties.
16. Privacy
Our collection and use of personal data is described in our Privacy Policy.
By using Momentory, you acknowledge that personal data may be processed as necessary to provide the service, including account management, event gallery operation, guest uploads, payment processing, support, and security.
