Distance Sales Agreement

1. Parties

This agreement is entered into electronically between WIT SOCIAL LLC, acting for Momentory as the service provider, and the consumer completing the purchase through the platform.

2. Subject Matter

The subject of this agreement is the sale and supply of digital event album services, QR-based guest access, media collection tools, and related management features purchased through Momentory.

3. Scope of the Service

The purchased package may include creation of one event album, guest uploads via QR code or direct link, moderation tools, and other features described on the relevant product or pricing page at the time of purchase.

4. Price and Payment

The service fee is the amount displayed during checkout. Payment is collected through the supported online payment methods available at the time of purchase.

Activation of the service begins after successful payment confirmation.

5. Delivery and Activation

Momentory provides digital services. Delivery is deemed completed when access to the purchased service is activated on the relevant user account and event record.

6. Right of Withdrawal

Consumers may have a statutory fourteen-day right of withdrawal unless an exception applies under applicable law. Where performance of a digital service begins before the withdrawal period ends at the consumer’s express request, or where the service has been fully performed, the right of withdrawal may be limited or lost under applicable law.

7. Consumer Obligations

The consumer is responsible for providing accurate and up-to-date information during purchase and for ensuring that uploaded content does not violate applicable law or third-party rights.

8. Use of the Service and Content

The user must hold the necessary rights to all uploaded content. Momentory reserves the right to limit access to or remove content that violates applicable law or platform rules.

9. Disputes

Any disputes arising from this agreement may be brought before the competent consumer arbitration committees or consumer courts under applicable law.
